July 30 - The United States Attorney's Office has moved to dismiss the Indictment against Holdings, an Agility subsidiary.
While the prosecutors' motives for seeking this dismissal at this time are unknown, this request for dismissal comes after motions filed by Holdings to discover the government's evidence against it, including but not limited to the Price Negotiation Memorandum.
Agility has consistently maintained since the outset of this litigation, this case should never have been brought in the first place in a criminal court and states that this case is, at most, a civil contract dispute over the interpretation of a contract drafted by the government.
Agility states that it remains committed to attempting to resolve this civil contract dispute so that the distraction of litigation is removed.
